Glasfraktur operates this store and website, including all related information, content, features, tools, products and services, to provide you, as a customer, with a personalised shopping experience (the “Services”). Glasfraktur is powered by Shopify, which enables us to provide the Services. This Privacy Policy describes how we collect, use or disclose personal information when you visit or use the Services, make a purchase or other transaction using the Services, or otherwise communicate with us. If there is a conflict between our Terms and Conditions and this Privacy Policy, this Privacy Policy takes precedence with respect to the collection, processing and disclosure of your personal information.

Please read this Privacy Policy carefully. By using and accessing any of the Services, you acknowledge that you have read this Privacy Policy and agree to the collection, use and disclosure of your information as described in it.

What personal information do we collect or process?

When we use the term “personal information”, we mean information that identifies you or another person, or can be directly linked to you. Personal information does not include information collected anonymously or anonymised so that it cannot identify or be associated with you. Depending on how you interact with the Services, where you live, and what applicable law permits or requires, we may collect or process the following categories of personal information, including inferences drawn from that information:

  • Contact details, including your name, postal address, billing address, delivery address, telephone number and email address.
  • Financial information, including credit card, debit card and financial account numbers, payment card information, financial account information, transaction details, payment method, payment confirmation and other payment details.
  • Account information, including your username, password, security questions, configurations and settings.
  • Transaction information, including items you view, add to your basket or wish list, purchase, return, exchange or cancel, and your past transactions.
  • Communications with us, including information you provide when communicating with us, for example when submitting a customer support enquiry.
  • Device information, including information about your device, browser or network connection, IP address and other unique identifiers.
  • Usage information, including information about your interaction with the Services, including how and when you interact with or browse them.

Sources of personal information

We may collect personal information from the following sources:

  • Directly from you. This includes information collected when you create an account, access or use the Services, communicate with us or otherwise provide us with personal information.
  • Automatically through the Services. This includes information collected from your device, when you use our products or Services or visit our website, and through cookies and similar technologies.
  • From our service providers. This includes information collected when we engage service providers to enable certain technologies, and when they collect or process your personal information on our behalf.
  • From our partners and other third parties.

How do we use your personal information?

When you use our website and Services, we process your personal information pursuant to Article 6(1)(a), (b) and (f) GDPR for the following purposes:

  • Providing, personalising and improving the Services. We use your personal information to provide the Services. This includes fulfilling our contract with you, processing payments, fulfilling orders, remembering your configurations and items you are interested in, sending account-related notifications, creating, maintaining and otherwise managing your account, arranging delivery, facilitating returns and exchanges, enabling you to leave reviews, and creating a personalised shopping experience, for example by recommending products based on your purchases. This may also include using your personal information to better tailor and improve the Services.
  • Marketing and advertising. We use your personal information for marketing and advertising, for example to send marketing and advertising communications by email, text message or post, and to display online advertisements for products or services on the Services or other websites. This may be based on items you previously purchased or placed in your basket and other activity relating to the Services.
  • Security and fraud prevention. We use your personal information to authenticate your account, provide a secure payment and shopping experience, detect, investigate or take action concerning possible fraudulent, illegal, unsafe or malicious activity, protect public safety and keep our Services secure. If you choose to use the Services and register an account, you are responsible for protecting your account credentials. We strongly recommend that you do not share your username, password or other access credentials with anyone else.
  • Communicating with you. We use your personal information to provide customer support and effective Services, respond promptly to your enquiries and maintain our business relationship with you.
  • Legal reasons. We use your personal information to comply with applicable law or respond to lawful legal processes, including requests from law enforcement or regulatory authorities; to investigate or participate in civil investigations, potential or actual litigation or other adversarial proceedings; and to investigate potential breaches of, or enforce, our terms or policies.

How do we disclose personal information?

In certain circumstances, we may disclose personal information to third parties for legitimate purposes in accordance with this Privacy Policy. Such circumstances may include:

  • With Shopify, vendors and other third parties that provide services on our behalf, such as IT management, payment processing, data analytics, customer support, cloud storage, fulfilment and delivery.
  • With business and marketing partners that provide marketing services and display advertisements to you. For example, we use Shopify to support personalised advertising through third-party services based on your online activity across different merchants and websites. Our business and marketing partners use your information in accordance with their own privacy policies. Depending on where you live, you may have the right to instruct us not to disclose information about you for the purpose of showing you targeted advertising and marketing based on your online activity across different merchants and websites.
  • When you direct us or otherwise consent to the disclosure of certain information to third parties, for example to deliver products to you, or when you use social media widgets or login integrations.
  • With our affiliates or otherwise within our corporate group.
  • In connection with a business transaction, such as a merger or bankruptcy; to comply with applicable legal obligations, including responding to subpoenas, search warrants and similar requests; to enforce applicable terms of service or policies; and to protect or defend the Services, our rights and the rights of our users or others.

Relationship with Shopify

We use “Shopify” to operate our online store. The service is provided by Shopify International Ltd., Victoria Buildings, 2nd Floor, 1–2 Haddington Road, Dublin 4, D04 XN32, Ireland.

1. Shopify as a processor

Shopify provides the technical infrastructure for our online store, including hosting, the store system, order processing, payment integration, IT security, maintenance and support. Where Shopify processes personal information on our behalf in this context, it acts as a processor pursuant to Article 28 GDPR on the basis of an appropriate data processing agreement.

In particular, we process the following information through Shopify:

  • Order and contract information
  • Customer account information
  • Payment information
  • Communication information
  • Technical usage information

2. Processing by Shopify as an independent controller

Where Shopify processes personal information for its own purposes, Shopify is an independent controller within the meaning of the GDPR.

This applies in particular to processing:

  • To ensure the security and integrity of the platform
  • To prevent fraud at platform level
  • For technical optimisation and further development of Shopify services
  • For its own analytics and statistical purposes
  • To provide marketing and advertising services across platforms, such as personalised advertising

We do not have full control over this processing.

The Services are hosted by Shopify. Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit to the Services is disclosed to Shopify and to third parties that may be located in countries other than your country of residence, in order to provide and improve the Services for you. To protect, grow and improve our business, we also use certain enhanced Shopify features that incorporate data and information from your interactions with our store, with other merchants and with Shopify. To provide these enhanced features, Shopify may use personal information collected from your interactions with our store, other merchants and Shopify. In these circumstances, Shopify is responsible for processing your personal information, including responding to requests to exercise your rights regarding the use of your personal information for these purposes. For more information about how Shopify uses your personal information and the rights you have, please see the Shopify Consumer Privacy Policy. Depending on where you live, you may exercise certain rights concerning your personal information listed there through the Shopify Privacy Portal.

Social plugins

We use social plugins from the “Instagram” social network, operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA. The plugins can be identified by their respective logos. They are initially deactivated, so no direct connection to the third-party providers’ servers is established. Data is transmitted to the relevant sites only when you activate these buttons yourself. By activating the plugins, you inform the third-party provider (Facebook, Google+) that your browser has accessed the relevant page of our website, even if you do not have a Facebook account or are not currently logged in to Facebook. This information, including your IP address, is transmitted directly from your browser to a Facebook server in the USA and stored there.

Third-party websites and links

The Services may provide links to websites or other online platforms operated by third parties. If you follow links to websites that are not affiliated with or controlled by us, you should review their privacy and security policies and other terms and conditions. We do not warrant and are not responsible for the privacy or security of such websites, including the accuracy, completeness or reliability of the information on them. Information you provide in public or semi-public places, including information you share on third-party social networking platforms, may also be viewed by other users of the Services and/or users of those third-party platforms, without restrictions on its use by us or by a third party. Our inclusion of such links does not imply that we endorse the content of those platforms or their owners or operators, unless expressly stated in the Services.

Children’s information

The Services are not intended for use by children, and we do not knowingly collect personal information from children who are below the age of majority in your country. If you are the parent or guardian of a child who has provided us with personal information, you may contact us using the details below to request its deletion. As of the effective date of this Privacy Policy, we have no knowledge that we “share” or “sell” personal information of individuals under 16 years of age, as those terms are defined by applicable law.

Security and retention of your information

Please note that no security measures are perfect or impenetrable, and we cannot guarantee “perfect security”. Information you send to us may also be at risk while in transit. We recommend that you do not use insecure channels to send us sensitive or confidential information.

How long we retain your personal information depends on various factors, including whether we need it to manage your account, provide Services, comply with legal obligations, resolve disputes or enforce other applicable agreements and policies. We retain personal information only for as long as necessary for the relevant processing purposes or as required by statutory retention obligations.

Your rights and choices

Depending on where you live, you may have some or all of the rights below concerning your personal information. These rights are not absolute, may apply only in certain circumstances, and in some cases we may decline your request to the extent permitted by law.

  • Right of access. You may have the right to request access to personal information we hold about you.
  • Right to deletion. You may have the right to request that we delete personal information we hold about you.
  • Right to rectification. You may have the right to request that we correct inaccurate personal information we hold about you.
  • Right to data portability. You may have the right to receive a copy of the personal information we hold about you and to request that we transfer it to a third party in certain circumstances and subject to certain exceptions.
  • Managing communication preferences. We may send you promotional emails. You may opt out at any time by using the unsubscribe option included in our emails. If you opt out, we may still send non-promotional emails, for example about your account or orders you have placed.

If you live in the United Kingdom or the European Economic Area, you may also exercise the following rights in addition to those above, subject to the exceptions and limitations of local law:

  • Right to object and right to restrict processing. You may have the right to request that we stop or restrict the processing of personal information for certain purposes.
  • Withdrawal of consent. Where we rely on your consent to process personal information, you have the right to withdraw that consent. Withdrawing consent does not affect the lawfulness of processing based on consent before its withdrawal.

You may exercise these rights where indicated within the Services or by contacting us using the details below. More information about how Shopify uses your personal information and the rights you have, including rights concerning information processed by Shopify, is available at https://privacy.shopify.com/en.

You will not be disadvantaged for exercising these rights. Where permitted or required by applicable law, we may need to verify your identity before processing your requests. In accordance with applicable law, you may appoint an authorised agent to make requests to exercise your rights on your behalf. Before accepting a request from an agent, we require evidence that you have authorised the agent to act on your behalf. You may also need to verify your identity directly with us. We will respond to your request promptly in accordance with applicable law.

Complaints

If you have complaints about how we process your personal information, please contact us using the details below. Depending on where you live, you have the right to appeal our decision by contacting us using the details below, or to lodge your complaint with the relevant data protection authority. A list of the relevant data protection supervisory authorities is available for the European Economic Area.

International transfers

Please note that we may transfer, store and process your personal information outside your country of residence.

When transferring your personal information outside the European Economic Area or the United Kingdom, we rely on recognised transfer mechanisms, such as the European Commission’s Standard Contractual Clauses or equivalent agreements issued by the relevant competent authority in the United Kingdom, unless the transfer is to a country recognised as providing an adequate level of protection.

We may update this Privacy Policy from time to time, for example to reflect changes in our practices or for other operational, legal or regulatory reasons. We will post the revised Privacy Policy on this website, update the “Last updated” date accordingly and provide any notice required by applicable law.
